• Privacy Policy of Hockney AR App

    David Hockney, Inc. (“we,” “our,” or “us”) provides this privacy policy to describe how we collect, use, and share the information of individuals who use the Hockney AR App (“App”).

    Information Collection   -  We collect limited technical data necessary to provide the App’s services.  We may collect, on our own or through third-party partners, information such as: device identifiers; IP addresses; camera permission settings; type of device; information relating to your interactions with the App; and approximate location (country/region).  We may collect this information when you download or use the App.  We may also collect information you choose to provide to us outside the App, such as name and email address if you send us an inquiry.

    Information Use   -  We may use the information we collect for any lawful purpose, including the following:

    • To operate and improve our App;
    • To comply with the law and to maintain the security of our App; or
    • With your consent, or as otherwise disclosed at the time information is collected.

    Information Sharing   -  We may share the information we collect with other parties, including the following:

    • With third party vendors who process data on our behalf, such as third-party software development kits embedded in the App;
    • Our partners and affiliates;
    • As part of a corporate sale, merger, or acquisition, or other transfer of all or part of our assets, including as part of a bankruptcy proceeding;
    • Pursuant to a subpoena, court order, governmental inquiry, or other legal process or as otherwise required by law, or to protect our rights or the rights of third parties; and
    • With your consent or as otherwise disclosed at the time of data collection or sharing.

    Information Retention   -  We will process and store information we collect about you only for the period necessary to achieve the purpose of the storage, or as permitted by law.  The criteria used to determine the period of storage of information is the respective statutory retention period.  After expiration of that period, the corresponding information is routinely deleted, as long as it is no longer necessary for the fulfillment of a contract or the initiation of a contract.

    International Visitors   -  This section applies to those that use our App from the European Economic Area, Switzerland, or the United Kingdom.

    Purpose and Basis of Processing.  Sometimes, we process personal information with your consent.  On other occasions, we may process personal information when necessary to fulfill a contract or where required to do this by law.  We may also process personal information when it is in our legitimate interests to do this, such as for operating our App, providing customer service, or developing products.  We do so when our legitimate interests are not overridden by your data protection rights.

    International Transfers.  Please be aware that the personal information we collect may be transferred to and maintained on servers or databases located outside your state, province, country, or other jurisdiction, where the privacy laws may not be as protective as those in your location.

    Data Subject Rights.  Please note that you have the following rights, subject to certain exceptions and limitations:

    • The right to request access to the personal information we hold about you;
    • The right to request that we rectify or erase your personal information;
    • The right to request that we restrict or block the processing of your personal information;
    • Under certain circumstances, the right to data portability; and
    • Where we previously obtained your consent, the right to withdraw consent to processing your personal information.

    Complaint to Supervisory Authority.  You also have the right to file a complaint with the relevant supervisory authority (i.e., of your country or domicile) where David Hockney, Inc. has not addressed your concerns.
